These Terms & Conditions ("Terms") govern your access to and use of VisibleForms (the "Service"), operated by DiscoveryMark LLC ("DiscoveryMark", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service
VisibleForms lets you turn HTML, ZIP files, and other web content into a live, shareable link. We may add, change, or remove features at any time. We may also suspend or discontinue the Service, in whole or in part, with or without notice.
Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Your Content
You retain ownership of the content you publish through the Service. By publishing content, you grant us a limited license to host, store, reproduce, and deliver that content solely for the purpose of operating and providing the Service. You represent that you have all rights necessary to publish your content and that it does not violate any law or third-party right.
Acceptable Use
You agree not to use the Service to publish or distribute content that:
- Is unlawful, infringing, defamatory, or fraudulent.
- Contains malware, phishing, or other malicious code.
- Impersonates any person or organization or misrepresents your affiliation.
- Violates the privacy or intellectual property rights of others.
- Is used to send spam or to harass, abuse, or harm others.
We may remove content or suspend accounts that violate these Terms.
Plans and Payment
Some features require a paid plan. Paid plans are billed on a recurring basis until cancelled. You authorize us to charge your payment method for applicable fees. Fees are exclusive of taxes unless stated otherwise. We may change pricing on a prospective basis with reasonable notice.
Refunds
Paid subscriptions may be cancelled at any time, and your plan will remain active through the end of the current billing period. Except where required by law, fees already paid are non-refundable. If you believe you were charged in error, contact us at austin@visibleforms.com and we will review your request in good faith.
Intellectual Property
The Service, including its software, design, and branding, is owned by DiscoveryMark LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of Liability
To the maximum extent permitted by law, DiscoveryMark LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and close your account at any time.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
